The following hearing of the International Court of Appeal took place in Paris on 4 September 2019:

Case ICA-2019-03: Appeal lodged by Leopard Racing Team Audi Sport against the Decision No 18 dated 6 July 2019 of the Stewards of the Race of Portugal counting towards the 2019 FIA World Touring Car Cup (WTCR).
Case ICA-2019-04: Appeal lodged by Leopard Racing Team Audi Sport against the Decision No 39 dated 7 July 2019 of the Stewards of the Race of Portugal counting towards the 2019 FIA World Touring Car Cup (WTCR).
Case ICA-2019-05: Appeal lodged by Comtoyou Team Audi Sport against the Decision No 17 dated 6 July 2019 of the Stewards of the Race of Portugal counting towards the 2019 FIA World Touring Car Cup (WTCR).
Case ICA-2019-03
On the basis of a report from the FIA Technical Delegate, on 6 July 2019, the Stewards appointed for the Race of Portugal found that car No. 69 (driver Jean-Karl Vernay) was in breach of Appendix 1 of the 2019 FIA WTCR Sporting Regulations, as it was found to be disrespecting the maximum boost pressure published in the Balance Of Performance chart for the event (0.45% instead of 0.30%). The Stewards therefore decided to disqualify the car No. 69 from Race 1.
Case ICA-2019-04
On the basis of a report from the FIA Technical Delegate, on 7 July 2019, the Stewards appointed for the Race of Portugal found that car No. 69 (driver Jean-Karl Vernay) was in breach of Appendix 1 of the 2019 FIA WTCR Sporting Regulations, as it was found to be disrespecting the maximum boost pressure published in the Balance Of Performance chart for the event (0.43% instead of 0.30%). The Stewards therefore decided to disqualify the car No. 69 from Race 3.
Case ICA-2019-05
On the basis of a report from the FIA Technical Delegate, on 6 July 2019, the Stewards appointed for the Race of Portugal found that car No. 22 (driver Frédéric Vervisch) was in breach of Appendix 1 of the 2019 FIA WTCR Sporting Regulations, as it was found to be disrespecting the maximum boost pressure published in the Balance Of Performance chart for the event (0.44% instead of 0.30%). The Stewards therefore decided to disqualify the car No. 22 from Race 1.
On 10 July 2019, Leopard Racing Team Audi Sport and Comtoyou Team Audi Sport decided to appeal Decisions No. 18, 39 and 17 taken by the Stewards during the Race of Portugal.
Decision of the International Court of Appeal
The Court, after having heard the parties and examined their submissions, decided:
- To declare the Appeals admissible;
- To set aside Decisions Nos. 17, 18 and 39 of the Stewards of the Race of Portugal counting towards the 2019 FIA World Touring Car Cup (WTCR);
- To impose a suspended fine of Euros 30,000 on Leopard Racing Team Audi Sport;
- To declare that the payment of this fine shall become due if, within a period of two years from the date of the Court’s decision, Leopard Racing Team Audi Sport commits a breach of the overboost limits set in the Balance of Performance Chart applicable at that time, during an event of the FIA World Touring Car Cup (WTCR);
- To impose a suspended fine of Euros 15,000 on Comtoyou Team Audi Sport;
- To declare that the payment of this fine shall become due if, within a period of two years from the date of the Court’s decision, Comtoyou Team Audi Sport commits a breach of the overboost limits set in the Balance of Performance Chart applicable at that time, during an event of the FIA World Touring Car Cup (WTCR);
- To order the competent Sporting Authority to draw, as appropriate, the consequences of this ruling.
The International Court of Appeal was presided over by Mr Rui BOTICA SANTOS (Portugal), and included Mr Riccardo LA COGNATA (Italy), Mr Dieter ROSSKOPF (Germany) and Mr Felippe ZERAIK (Brazil).
